Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Gradify PoliceTrust platform (the “Platform”) and this website (the “Website”), each provided by Gradify Labs LLP (“Gradify Labs”, “we”, “us”). By accessing the Website or using the Platform, you agree to these Terms. Where a signed agreement exists between Gradify Labs and a deploying department, that agreement prevails over these Terms to the extent of any conflict.

Your data never leaves the police station.

Gradify PoliceTrust is deployed as an on-premise / department-hosted system. All operational data (First Information Reports (FIRs), case files, evidence records, chain-of-custody logs, personal data of complainants, witnesses and accused persons, and every blockchain record) is stored, processed and controlled exclusively on servers owned and operated by the deploying police station, district police unit or state police department. Gradify Labs LLP does not host, store, mirror, copy or retain a back-up of this operational data on any Gradify-controlled infrastructure. The department is the sole data controller and data fiduciary; we act only as a technology provider and, where contracted, as a data processor operating strictly within the department's own environment.

01Acceptance of terms

By accessing the Website or authorising, installing or using the Platform, you confirm that you have read, understood and agreed to be bound by these Terms and by the documents referenced in them, including the Privacy Policy and Cookie Policy. If you do not agree, do not use the Website or the Platform.

02Definitions

  • “Platform”: the Gradify PoliceTrust software, including its AI modules, permissioned-blockchain components, dashboards, APIs and documentation.
  • “Department”: the police station, district police unit, State Police organisation or government body that deploys or procures the Platform.
  • “Authorised User” : an officer, supervisor, forensic staff member, administrator or citizen granted access by the Department in accordance with its role-based access policy.
  • “Operational Data” : all data created, uploaded or generated in the course of using the Platform, including FIRs, cases, evidence, custody logs and ledger records.

03Eligibility & authority

The Platform is intended solely for use by authorised government law- enforcement entities and their Authorised Users. By using the Platform you represent that you are duly authorised by the Department and that your use complies with all laws, service rules and departmental policies applicable to you.

04Deployment model & data custody

The Platform is delivered as an on-premise, department-hosted or GovCloud / State-data-centre deployment. This is a defining feature of how the service works:

  • All Operational Data is stored and processed exclusively on servers owned or controlled by the Department.
  • Gradify Labs does not host, store, mirror, back up or retain any copy of Operational Data on Gradify-controlled infrastructure.
  • The Department retains custody of encryption keys, administrative credentials and access policies at all times.
  • Any support access by Gradify Labs is granted only at the Department's request, is time-bound, is logged, and takes place within the Department's environment.
Because Operational Data never leaves the Department, the Department remains in continuous control and can operate, audit and verify the system independently of Gradify Labs.

05Licence grant

Subject to these Terms and any executed agreement, Gradify Labs grants the Department a non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform for its internal policing operations during the term. All rights not expressly granted are reserved.

06Department responsibilities

  • Managing Authorised Users, roles and permissions, and promptly revoking access when no longer required.
  • Securing its own servers, network, encryption keys and credentials, and applying reasonable security controls.
  • Ensuring the lawfulness of the data it processes and the purposes for which it uses the Platform.
  • Complying with all applicable laws, including the DPDP Act, in its capacity as data controller / fiduciary of Operational Data.
  • Maintaining back-ups and business-continuity arrangements for data held on its infrastructure.

07Acceptable use

You agree not to, and not to permit any person to:

  • Use the Platform or Website for any unlawful, unauthorised or fraudulent purpose.
  • Attempt to gain unauthorised access to any system, account, data or node, or bypass role-based access controls.
  • Reverse-engineer, decompile, disassemble or attempt to derive source code, except to the extent permitted by law.
  • Introduce malware, interfere with the integrity or performance of the Platform, or tamper with audit logs or ledger records.
  • Resell, sublicense or make the Platform available to any third party outside the Department without authorisation.
  • Submit citizen-sensitive or evidentiary data through the public Website contact form.

08Availability & support

Because the Platform runs on Department-controlled infrastructure, availability depends significantly on the Department's own environment. Support, maintenance windows, service levels and upgrade procedures are as set out in the applicable agreement or support plan. We may release updates and improvements from time to time.

09Fees & government procurement

Fees, licensing metrics, payment terms and procurement conditions are governed by the applicable purchase order, tender, or Master Services Agreement between Gradify Labs and the Department. Nothing on the Website constitutes a binding offer; commercial terms are established only through an executed agreement.

10Intellectual property

The Platform, the Website, and all associated software, designs, trademarks, logos, documentation and know-how are and remain the exclusive property of Gradify Labs LLP and its licensors. These Terms grant a licence to use the Platform, not any transfer of ownership. “Gradify PoliceTrust” and “Gradify Labs” are marks of Gradify Labs LLP.

11Data ownership & processing

The Department owns all Operational Data. Gradify Labs claims no ownership of it and, as noted above, holds no copy of it. Where Gradify Labs acts as a data processor, it does so only on the Department's documented instructions and within the Department's environment, as further described in the Privacy Policy and any Data Processing Agreement. Gradify Labs does not use Operational Data to train its own models.

12Third-party & government systems

The Platform is designed to operate alongside existing government systems such as CCTNS and ICJS, and may interoperate with third-party services. Gradify Labs is not responsible for the availability, accuracy, security or policies of systems it does not control. Integrations are subject to the applicable governing authorities and agreements.

13Warranties & disclaimers

The Platform and Website are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Gradify Labs disclaims all warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free, particularly where operation depends on Department-controlled infrastructure. Nothing in this section limits any warranty that cannot be excluded by law.

14Limitation of liability

To the maximum extent permitted by law, Gradify Labs shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, profits, goodwill or business, arising out of or relating to the use of the Platform or Website. Gradify Labs' aggregate liability arising out of or relating to these Terms shall not exceed the amounts (if any) paid by the Department to Gradify Labs for the Platform in the twelve (12) months preceding the event giving rise to the claim, or as otherwise set out in the applicable executed agreement. These limitations do not apply to liability that cannot be limited under applicable law.

15Indemnification

Each party shall be responsible for its own acts and omissions. Subject to the applicable executed agreement, you agree to indemnify Gradify Labs against claims arising from your unlawful use of the Platform, your breach of these Terms, or your handling of Operational Data in violation of applicable law.

16Term & termination

These Terms apply while you use the Website or Platform. Deployment term, renewal and termination are governed by the applicable agreement. On termination, the Department retains its Operational Data on its own infrastructure; because Gradify Labs holds no copy, there is no Gradify-side data-return or deletion step for Operational Data. Licence rights to the Platform cease on termination.

17Confidentiality

Each party may receive confidential information of the other. Each party shall protect the other's confidential information with at least reasonable care, use it only for the purposes of these Terms, and not disclose it except as required by law or to personnel and advisers bound by confidentiality obligations.

18Governing law & dispute resolution

These Terms are governed by the laws of India. Subject to any dispute- resolution mechanism in an executed government contract, the courts at Jaipur, Rajasthan shall have jurisdiction, and the parties shall first attempt to resolve disputes amicably.

19Changes to these terms

We may update these Terms from time to time. The “Last updated” date reflects the latest revision. Continued use of the Website or Platform after changes take effect constitutes acceptance of the revised Terms. For deployed departments, changes are communicated through the contractual notice mechanism.

20Contact us

This document forms part of the contractual and disclosure framework governing the use of Gradify PoliceTrust. It should be read together with the Privacy Policy, the Terms of Service, the Cookie Policy and the Security Disclosures. Where a signed Master Services Agreement, Data Processing Agreement or government procurement contract exists between Gradify Labs LLP and a deploying department, the terms of that executed agreement prevail over this document to the extent of any conflict.
